Man who lost hand to alligator charged with unlawful feeding

Weatherholt (Collier County Sheriff's Office)

Talk about adding insult to injury: An Everglades tour guide who lost his hand to an alligator last month was arrested over the weekend, charged with unlawful alligator feeding.

Wallace Weatherholt, a 63-year-old airboat captain, was leading a tour on June 12 when the group encountered a 9-foot alligator. Passengers told the Fort Myers News-Press that Weatherholt "hung a fish over the side of the boat and had his hand at the water's surface when the alligator attacked."

Wildlife officials then tracked and killed the alligator, according to the paper. They "retrieved Weatherholt's hand from its stomach, but doctors were unable to reattach it."

Weatherholt was charged with unlawful feeding, a second-degree misdemeanor, on Friday. He posted $1,000 and was released from Collier County Jail.

Feeding alligators is illegal in the state of Florida, where at least 19 people have been cited in the last two years, according to West Palm Beach's WPTV. The charges carry a fine of up to $500 and possible jail time.

Trade Union Boss Says Green Jobs Are Bull****

Another undercover operation by Project Veritas, which is led by investigative video specialist James O?Keefe, has revealed what labor unions truly believe about the billions of dollars that go toward the alleged ?greening? of our energy usage. They?re ?bull****?

Those were the words that came out of the mouth of John Hutchings, a legislator for New York?s Broome County, who is also a construction market representative for the Laborers International Union for upstate New York. He is also an executive officer of the Central New York Labor Federation, AFL-CIO, according to his bio.

Project Veritas actors, who portrayed leaders of a make-believe company called Earth Supply and Renewal, captured the remark in a meeting they obtained with Hutchings and other union leaders to discuss the possibility (again, this was an act) of winning government grants or contracts for their work. The only problem was that Earth Supply and Renewal sold themselves as in the business of carrying out only a very simple task: digging holes, and filling them back in.

?And you guys would be cool with that?? asked a Veritas actor of the union leaders. ?With helping us find funds, even if it?s just ? what we do is just, ?Hey, there?s some dirt to dig,? and put it back in the hole??

Hutchings?s colleague Anthony Tocci, business manager for Laborers International Union-Local 161 on Long Island, replied, ?If people are willing to give you the money, that?s fine.?

Then Hutchings chimed in.

?You know the Green Jobs, Green New York?? he told the actors, referring to a $112-million state weatherization program. ?Between us, a lot of it is bullsh?.

?You know, a lot of that?s going for stuff that?.? Hutchings paused, then raised his hands in the air with a puzzled expression that emphasized the waste of taxpayer dollars and said, ?What are we talking about?? The point: He understood clearly that much of the New York weatherization program dollars were channeled to useless make-work projects.

Son of Southwest Minn. State coach dies in car crash

CBSSports.com wire reports

MARSHALL, Minn. -- Brad Bigler, the men's basketball coach at Southwest Minnesota State University, was in critical condition Sunday after a two-vehicle crash in western Minnesota that killed his 5-month-old son and injured two other relatives.

Bigler, 33, was hospitalized in Sioux Falls, S.D., with several broken ribs and a broken shoulder blade, SMSU athletic director Chris Hmielewski said. Drake Phillip Bigler, the coach's young son, was killed in the crash.

"Obviously it's a tragedy when you lose a young family member," Hmielewski told the Independent of Marshall. "The thoughts and prayers of the entire Mustang family and everybody should go out to the Bigler family as they cope with this situation."

Bigler has been head coach of the SMSU men's basketball program for three years. The Mustangs finished 19-11 last season, winning the Northern Sun Intercollegiate Conference tournament championship and making their third-ever appearance in the Division II tournament.

Bigler's wife, Heather Bigler, was driving in Pope County on Saturday evening when a truck driven by a 38-year-old Starbuck man crossed the center line and struck her vehicle, the Minnesota State Patrol said.

All four people in Bigler's vehicle were hurt. Heather Bigler suffered minor injuries, and her 74-year-old grandmother, Sharon Schuler of Granite Falls, was left in critical condition, authorities said.

The State Patrol said alcohol was detected in the Starbuck man's system, and is suspected as a factor in the crash.

State records show that the driver had been convicted of gross misdemeanor drunken driving in 2005 and for driving under the influence in 2000, according to the Minneapolis Star Tribune. In both cases, the man's blood-alcohol content was greater than 0.20, or 2? times the legal limit in Minnesota.

He also has convictions for reckless driving and speeding.

Before becoming head coach at the university in Marshall, Minn., Bigler previously served as an assistant coach at the school and played for the Mustangs for five seasons.

Hmielewski said the Bigler family sent him a text message early Sunday saying Brad Bigler's condition had improved overnight and that he was awake and coherent.

The crash marked the second tragedy for the Bigler family in just more than a year. Brad Bigler's mother, Diane Bigler-Hagenow, died last summer in a kayaking accident near Sacred Heart.

"We're going to surround the Bigler family with all the love and support they need, and we encourage everyone to do the same," Hmielewski said.

Where Lawyers and the Internet Meet: You Need a Technology ...

The internet is a very complicated place. There are web hosting companies, affiliate marketers. There are e-commerce agreements, clickwrap agreements. There?s social media defamation. There is any number of issues surrounding the DNS system, the Domain Name Server system. There?s ICANN which is the Internet Corporation for Assigned Names and Numbers. There?s the registration of domain names which are controlled by registries and are sold through registrars to registrants.

There are subpoena issues in terms of what kind of digital information can you get from internet service providers or ISPs. If you have to identify anonymous people on the internet there?s a whole piece of technology which a lawyer or an attorney has to understand, even to know where to go.

Welcome to Internet Law Radio where we discuss the hottest topics in Internet law.? If you are facing an Internet law issue, cyber law complaint, web site or e-commerce issue, we have an Internet lawyer ready to help.

The internet is a very complicated place.? There are web hosting companies, affiliate marketers. There are e-commerce agreements, clickwrap agreements. There?s social media defamation.? There is any number of issues surrounding the DNS system, the Domain Name Server system.? There?s ICANN which is the Internet Corporation for Assigned Names and Numbers.? There?s the registration of domain names which are controlled by registries and are sold through registrars to registrants.

There are subpoena issues in terms of what kind of digital information can you get from internet service providers or ISPs. If you have to identify anonymous people on the internet there?s a whole piece of technology which a lawyer or an attorney has to understand, even to know where to go.

My name is Internet Law Attorney Enrico Shaefer, and today we?re going to be talking a little bit about this merger between technology and the law.? There used to be, back before the internet, loosely defined technology attorneys, attorneys who understood about software and networks and hardware, and understood enough to be able to lend their legal expertise to clients who existed in those spaces.

But you know what?? The world has changed.? It?s a whole different place, and there?s a lot of business being done on the internet.? The primary calling card for every business is their website, which is a website on a domain name which consumers, and partners, and web visitors go to in order to see who you are and what you do.

So, these assets are incredibly important to virtually every business today. If you?ve got an issue, which somehow deals with your website, your domain name, or with the internet itself, you?re going to need an attorney who not only understands the area of law involved, but perhaps even more importantly understands how the internet works.? A lawyer who does not understand the back-end technology of the internet isn?t going to be able to accomplish results for you as the client.

Attorneys and lawyers today, many of them actually use the internet, right?? They use email.? They get the same spam messages that you do, and they worry about anti-spam laws. But do they really understand how different aspects of the internet and the World Wide Web actually work? The answer is a resoundingly ?no?.? Very few of the older, more experienced lawyers have any experience in internet and technology representation.

So, the most important thing that you need to understand as a client when taking a look at law firms and interviewing attorneys in order to understand who?s going to be able to help you with your internet-based client, with your internet-based problem, is that you need to ask both sides of the equation.? You need to ask your attorneys and your prospective lawyers who you?re taking a look at to hire, not only what the legal issue is, but what is going to have to happen on the technology side in order to accomplish a result?

So, let me give you a couple of examples.? Let?s say that you are a small business or start-up company that is trying to secure a domain name that matches your trademark.? So, there are a number of landing pages out there on domain names which are a good match for your trademark and no one appears to be using those web pages. So, a common question you might have is, ?Well, if I go ahead and register my trademark, can I then go get that domain name??

Well, there are special statues and policies and arbitrations which exist in order to resolve trademark and domain name disputes.? You?re going to need a lawyer who not only understands the law, but understands how the domain name system works, how the Uniform Domain Name Dispute Resolution Policy works, and identify for you your options of securing an unused or a lander page domain name that is going to be the one you?re going to want to launch your business on.

Let?s say you?re a small business or internet start-up company and you?re looking for a lawyer, because someone has defamed you on the internet. Let?s say you?ve been in business for about four years now and you?re growing, but one of your competitors has posted a bogus customer review, alleging that you provide poor customer service and that you didn?t honor your warranties.

Well, if that is posted on a third-party website you need an attorney who not only understands defamation law, but understands how web hosts and website operators work, and what their typical policies are with regards to removing third-party user-generated content that?s alleged to be defamation.

Let me give you another example.? Let?s say you?re a nice little e-commerce business doing say $10 million worth of revenue a year and you?ve been growing very quickly. You?re selling ceiling fans online through a variety of different domain names and websites that your company has built over time.

You do all your original artwork and so all of the different graphics and photographs displaying the different ceiling fans that you have on your website are copyright-owned by you and your company. But your competitors or others start using those original pieces of artwork, those original photographs by your company to display product on eBay, on Amazon, on Buy.com, on other e-commerce sites.

What are your options as a potential copyright owner to have those web pages removed, those accounts blocked by eBay and other vendors and potentially to have the photographs taken down? You?re going to need, not only a copyright law attorney to help you out, but that copyright law attorney is going to have to understand the internet and online space. Otherwise, they will not have any idea what results are achievable and who you can assert leverage against with regards to copyright infringement.

Again, there are special statutes which deal with online copyright infringement and user-generated content.? So, these are the types of things that any good technology and internet lawyer will be able to help you with.

So, when you go out and you list all your requirements on Google and you get those search returns and you find an attorney who you think is going to be good, make sure you take a look at what their technology and internet background is in addition to the substantive area of law that may apply to your specific situation. My name is Internet Law Attorney Enrico Shaefer. We?ll see you next time.

You?ve been listening to Internet Law Radio.? Whether you are facing a domain name, intellectual property or a complex litigation issue, we have an Internet law attorney ready to answer your questions.

Why Sally Ride's sexuality really matters

America's first woman in space blazed a trail for equality in the sciences thanks to her sex and her sexuality

My girlfriend was the one who pointed out to me that Sally Ride had a female partner.

I was a mess on Monday when I learned that Ride, who became the first American woman to fly in space in 1983, had died. I had no idea she was even sick ? at her request, NASA had kept her 17-month battle with pancreatic cancer secret.

Ride was one of my childhood heroes. I dressed as her for Halloween when I was aged eight and my lifelong passion for space was first budding. Ride's legacy is mostly one of inclusion: bringing more women into science, encouraging girls to think they can do anything. She was a living example of how to crush gender stereotypes, even as she dodged sexist questions from the media. Her first flight on the space shuttle Challenger was before I was born. Thanks to her, I grew up in a world where my sex was not a barrier to the stars.

It runs even deeper for me, as a science writer. When I found out she had double majored in physics and English in college, I felt an intense feeling of identification ? she was like me. I too loved both science and words, and felt a bit of tension about it ? but if the first American woman in space could cross that line, I could too.

And I felt that same sense of recognition when my girlfriend read me this line from Ride's obituary, that she was "survived by her partner of 27 years, Tam O'Shaughnessy." I was elated. Again, Sally Ride was someone like me.

This is why I think Ride's sexuality matters. If her gender matters for diversity reasons, her sexuality matters too, for the same reason.

Role models only work if you see yourself reflected in them. When young people imagine their possible futures ? what career to pursue, where to live, who to spend time with ? one of the most important questions in deciding what path to take is, "Will I find people like me there?"

Psychologists call this "ambient belonging", and it's been shown to have an effect on things like college students' choice of subjects. If you feel that your gender, race, sexuality or love of science fiction sets you apart, then seeing people like you in a certain field will make you more likely to go into it. And the reverse is also true.

Which makes things complicated when it comes to someone like Ride. She was neither out nor deeply in the closet, it seems. Ride doesn't appear to have kept her partnership with O'Shaughnessy particularly secret. They worked together and wrote books together. Would they have legally married if they could? We may never know. But Ride's sex was visible in a way that her sexuality wasn't. She didn't need to put much effort into hiding it for us to overlook it.

Even when you're actively looking, it can be hard to find reflections of yourself in the world. I know that it's not just me. The March meeting of the American Physical Society held the first-ever session on sexual and gender diversity issues in physics this year.

One of the organisers, Elena Long of Kent State University, had searched for resources for LGBT+ physicists ? or even just evidence that others existed ? and found nothing (LGBT stands for lesbian, gay, bisexual and transgender, while the plus sign includes other sexual orientations or gender identities including intersexed, queer, questioning, asexual or pansexual).

One of the main conclusions of the meeting was that having role models who are open about their sexuality, and having a support network was necessary for LGBT+ physicists to feel safe and comfortable in their departments ? and crucial to a successful career.

"I think showing successful academics who are out is an important way to dispel the notion that being out precludes or limits one's professional opportunities," wrote one anonymous attendee.

"There are other people like me who are further in their careers," wrote another. "I know a number of queer students or allies that are students, but I have no visible, contemporary queer scientist role models."

Now we have Sally Ride.?????????

PFT: Jones-Drew will be a no-show at camp

marshawnlynch-600x399Getty Images

To no surprise, Seahawks running back Marshawn Lynch has pleaded not guilty to DUI charges in Oakland, California.? To even less surprise, his lawyer believes that it?s going to take time to resolve the case.

?We will prove that Marshawn was not under the influence when he was pulled over on the evening in question,? lawyer Ivan Golde said, via the San Francisco Chronicle.? ?There is much investigation that needs to be done in this case in that there are many questions about what occurred that are unanswered at this time.? It is going to take some time to unravel everything and, when we do, I am very confident that Marshawn will be exonerated?completely.?

Regardless of whether such an extensive and detailed investigation is needed in order to determine whether Lynch?s blood-alcohol concentration equaled or exceeded the legal limit of 0.08 percent, a delayed resolution ensures that Lynch can?t be suspended in 2012, because he can?t be suspended until the case is resolved.

Even then, Lynch may not be suspended, despite a prior history of two off-field incidents.? As we?ve previously explained, DUIs fall under the substance-abuse policy, not the personal-conduct policy.? For a first-offense DUI (and Lynch is a first-time DUI offender), the penalty ordinarily is a fine in the amount of two game checks.

That said, if Lynch?s camp is confident there won?t be a suspension, he?d be wise to take his alcohol-free medicine in 2012, not 2013.? With a base salary of $4 million this year and $7 million next year, the two-game-check fine would cost $352,941.17 more next year than it would cost this year.

(That said, the Seahawks can always renegotiate his deal and slash his base salary, a fairly easy way to reduce the impact of fines tied to game checks.)

Regardless, even though Golde has created the impression that he wants to move quickly by moving the arraignment from August 15 to Thursday, look for Golde to deftly tap the breaks whenever and however he can.

Climate concerns

Friday, July 27, 2012

For decades, scientists have known that the effects of global climate change could have a potentially devastating impact across the globe, but Harvard researchers say there is now evidence that it may also have a dramatic impact on public health.

As reported in a paper published in the July 27 issue of Science, a team of researchers led by James G. Anderson, the Philip S. Weld Professor of Atmospheric Chemistry, are warning that a newly-discovered connection between climate change and depletion of the ozone layer over the U.S. could allow more damaging ultraviolet (UV) radiation to reach the Earth's surface, leading to increased incidence of skin cancer.

In the system described by Anderson and his team, water vapor injected into the stratosphere by powerful thunderstorms converts stable forms of chlorine and bromine into free radicals capable of transforming ozone molecules into oxygen. Recent studies have suggested that the number and intensity of such storms are linked to climate changes, Anderson said, which could in turn lead to increased ozone loss and greater levels of harmful UV radiation reaching the Earth's surface, and potentially higher rates of skin cancer.

"If you were to ask me where this fits into the spectrum of things I worry about, right now it's at the top of the list," Anderson said. "What this research does is connect, for the first time, climate change with ozone depletion, and ozone loss is directly tied to increases in skin cancer incidence, because more ultraviolet radiation is penetrating the atmosphere."

Unfortunately, Anderson said, we don't know how this process will evolve over time.

"We don't know what the development of this has been ? we don't have measurements of this deep convective injection of water into the stratosphere that go back in time," Anderson said.

"But the best guide for the evolution of this is to look at the research that connects climate change with severe storm intensity and frequency, and it's clear that there is a developing scientific case that the addition of carbon dioxide to the atmosphere is increasing climate change, and in turn driving severe storm intensity and frequency."

While it's impossible to know how many skin cancer cases may be related to ozone depletion over the U.S., the link between ozone loss and increased incidence of the disease has been extensively studied, Anderson said.

"There has been a major effort by the medical community to define the relationship between decreases in ozone and the subsequent increases in skin cancer," he said. "The answer is quite clear ? if you multiply the fractional decrease in ozone protection by about three, you get the increase in skin cancer incidence. There are 1 million new skin cancer cases in the U.S. annually ? it's the most common form of cancer, and it's one that's increasing in spite of all the medical research devoted to it."

But it isn't only humans who have to worry about the effects of increased UV radiation.

Many crops, particularly staple crops grown for human consumption ? such as wheat, soybeans and corn ? could suffer damage to their DNA, Anderson said.

Ironically, Anderson said, the discovery that climate change might be driving ozone loss happened virtually by accident.

Though they had worked since the mid-1980s to investigate ozone depletion in the Arctic and Antarctic, by the early-2000s, Anderson's team had turned their attention to climate studies. In particular, they were working to understand how the convective clouds ? updrafts that cause storms to build high into the sky ? contribute to the creation of cirrus clouds.

"It was in the process of looking at that mechanism that we came to this unexpected observation ? that the convective clouds in these storm systems over the U.S. are reaching far deeper into the stratosphere that we ever expected," Anderson said.

While earlier tests performed in the Arctic had demonstrated that water vapor was a key component in creating the "free-radical" compounds that break down ozone, Anderson said the latest finding is much more troubling, because it suggests the process can happen at much higher temperatures than initially suspected.

"The bottom line is that if you increase the water vapor concentration, you actually increase the threshold temperature for executing this chemical conversion ? from the stable forms of chlorine to the free radical form," Anderson said. "If the amount of water vapor and the temperature over the U.S. satisfies the conditions for rapid conversion of inorganic chlorine to this free-radical form, we've got a real problem, because the chemistry is identical to what we previously demonstrated is taking place over the Arctic."

Also surprising, he added, was the realization that, to throw water vapor high into the atmosphere, storms needn't be unusually large.

"We have hundreds of measurements world-wide addressing the photochemical structure controlling ozone, but only a limited number of flights over the U.S. in summer," he said. "The flights were studying average storms over the middle-west, and of the 20 observations we made over the U.S., about half demonstrated significant penetration into the stratosphere," he said.

The next step in the research, Anderson said, is to conduct a series of tests to confirm whether the free-radical form of chlorine and bromine are present in the stratosphere at significantly elevated levels in the presence of convectively-injected water vapor.

"In my mind, this is not just a broad public health issue," Anderson said. "This is about actually being able to step out into the sunlight ? it's about your children and your children's health. Of course, we don't know how rapidly the frequency and intensity of these storms will increase, so we can't place a time scale on this problem, but the core issue here is quite straightforward and simple, because we understand this chemistry."

DENVER (AP) ? Firearms sales are surging in the wake of the Colorado movie theater massacre as buyers express fears that anti-gun politicians may use the shootings to seek new restrictions on owning weapons.

In Colorado, the site of Friday's shooting that killed 12 and injured dozens of others, gun sales jumped in the three days that followed. The state approved background checks for 2,887 people who wanted to purchase a firearm ? 25 percent more than the average Friday to Sunday period in 2012 and 43 percent more than the same interval the week prior.

Dick Rutan, owner of Gunners Den in suburban Arvada, Colo., said requests for concealed-weapon training certification "are off the hook." His four-hour course in gun safety, required for certification for a concealed-weapons permit in Colorado, has drawn double the interest since Friday.

"What they're saying is: They want to have a chance. They want to have the ability to protect themselves and their families if they are in a situation like what happened in the movie theater," Rutan said.

Day-to-day gun sales frequently fluctuate, but the numbers also look strong outside of Colorado, too.

Seattle's home county, King, saw nearly twice as many requests for concealed pistol licenses than the same timeframe a year ago. Florida recorded 2,386 background checks on Friday, up 14 percent from the week before. Oregon sales on Friday and Saturday were up 11 percent over the month prior. Four days of checks in California were up 10 percent month-to-month.

During the past decade, June and July have consistently been the slowest months for gun sales, according to FBI data.

Jay Wallace, who owns Adventure Outdoors in Smyrna, Ga., found that his sales on Saturday were up 300 percent from the same day a year ago ? making it one of the best Saturdays his business has ever had. He said customers are often afraid when there's a gun-related tragedy that some lawmakers might try and push through an anti-gun agenda.

"We shouldn't let one sick individual make us forget and lose sight of freedoms in this country," Wallace said.

Authorities have said that the suspected Colorado shooter, James Holmes, methodically stockpiled weapons and explosives at work and home in recent months. He purchased thousands of rounds of ammunition and a shotgun, a semi-automatic rifle and two Glock pistols, authorities said.

On Friday, clad in head-to-toe combat gear, he burst into a midnight showing of "The Dark Knight Rises," tossed gas canisters into the crowd and opened fire. The shooting killed 12 people and wounded dozens of others.

Police in the Denver suburb of Aurora say Holmes also booby-trapped his apartment. Holmes is now in solitary confinement at a local jail.

The rise in gun sales reflects but one of the anxieties created by the shootings. Since the massacre, there have been reports of chaos at movie theaters, apparently sparked by misunderstandings or careless words.

A confrontation with an intoxicated man in an Arizona theater caused about 50 people to flee, authorities said. A southern California man was arrested after authorities say he made allusions to the Aurora massacre after the movie didn't start on time. In New Jersey, a showing of "Batman" was canceled after someone stood up during the movie, opened an emergency exit and then returned to their seat.

About 90 minutes into a Monday night showing of "Batman" in Santa Monica, Calif., shrieks from some girls sent about two dozen people sprinting for the exit. It turned out that a large man with a backpack was actually not a threat and was simply having a medical problem.

"This was nothing, and yet it startled us and rattled us so much," said moviegoer Paria Sadighi.

Nationally, the shootings have triggered a fierce debate over gun control and whether government has a role in reining in the ownership of firearms.

Gun sales often fluctuate based on news events, especially whenever people think the passage of more restrictive gun laws is imminent. Sales spiked following the election of President Barack Obama, when weapons enthusiasts expressed fear that the Democrat might curtail gun rights. FBI figures also show background checks for handgun sales jumped in Arizona following the shooting of U.S. Rep. Gabrielle Giffords in 2011.

"It's not uncommon for us to see spikes in requests for concealed pistol licenses when there's a significant gun-related tragedy," said Sgt. Cindi West of the King County sheriff's office in Washington state.

Some Democratic lawmakers in Congress cited the shooting as evidence of the need for tougher gun control laws ? particularly a ban on high-capacity ammunition magazines. Congress, however, hasn't passed strict legislation in more than a decade, and leaders in Washington show no sign of bringing up such measures any time soon.

Lady Gaga Sends Best Wishes to Robsten

Count Lady Gaga among the Robsten fans who have not given up hope.

During yesterday's frenzy of gossip over Kristen Stewart, Robert Pattinson and the former's fling with Rupert Sanders, Gaga sent out the following Tweet:

"Geez this kirstew rob stuff is brutal. Makes me sad the way press acts. Hope they're ok."

Lady Gaga on TwitterPhoto of Kristen Stewart

The pop star wrote that message earlier in the day, however, making it unclear if she was aware of the photos that soon leaked out proving Stewart and Sanders did, indeed, hook up. Or of Stewart's eventual admission.

Since then, the Snow White and the Huntsman director has also apologized and owned up to his actions, while millions of Twilight Saga fans wonder about the fate of Rob and Kristen.

Some of them are also reacting in far less measured tones than Gaga.

Mortgage Rates Drop Even Further; Which refinancing option is best ...

By Robert Fishel, on July 25th, 2012

Every borrower?s situation is different. My goal is to provide various options/loan programs that are available to meet the borrower?s needs. When considering a refinance, the following are typical situations borrowers face:

Are you refinancing primarily to lower your rate and monthly payments? Your best option might be a low fixed-rate loan. Maybe you have a fixed-rate mortgage now with a higher rate, or maybe you have an ARM ? adjustable rate mortgage ? where the interest rate varies. Even if it?s low now, unlike your ARM, when you qualify for a fixed-rate mortgage you lock that low rate in for the life of your loan. This is especially a good idea if you don?t think you?ll be moving within the next five years or so. On the other hand, if you do see yourself moving within the next few years, an ARM with a low initial rate might be the best way to lower your monthly payment.

Are you refinancing primarily to cash out some home equity? Maybe you want to pay for home improvements, pay your child?s college tuition bill or possibly payoff other debt, e.g., credit cards, high interest rate loans, etc. Then you?ll want to qualify for a loan for more than the balance remaining on your current mortgage. If you?ve had your current mortgage for a number of years and/or have a mortgage whose interest rate is higher, you may be able to do this without increasing your monthly payment.

Do you want to build up home equity more quickly, and pay off your mortgage sooner? Consider refinancing with a shorter-term loan, such as a 15-year mortgage. Your payments will be higher than with a longer-term loan, but in exchange, you will pay substantially less interest and will build up equity more quickly. If you have had your current 30-year mortgage for a number of years and the loan balance is relatively low, you may be able to do this without increasing your monthly payment ? you may even be able to save!

Whatever the situation, the low interest rates we are currently seeing in the market place could provide an opportunity to save money, provide some liquidity (cash out) or payoff your home at a much faster pace.

MORTGAGE INTEREST RATES for July 25, 2012:

  • Conventional 30-Year Fixed 3.500%/ 3.553% APR
  • Conventional 15-Year Fixed 2.875%/ 2.969% APR
  • Conventional 5/1 ARM 2.625%/ 3.347% APR
  • FHA/VA 30 Year Fixed 3.25%/ 3.302% APR
  • Jumbo 5/1 ARM 2.750%/ 2.422% APR
  • Jumbo 15 yr Fixed 3.375%/ 3.630% APR
  • Jumbo 30 yr Fixed 4.750%/ 5.010% APR

Polar bears' ancient roots pushed way back

Genetic blueprints suggest the animals arose millions of years ago

Web edition : Monday, July 23rd, 2012

The polar bear has been around for a surprisingly long time. A new analysis of its DNA suggests that Ursus maritimus split from the brown bear between 4 million and 5 million years ago ? around the same time when, some scientists believe, the Arctic?s thick sea ice first formed.

With such old origins, the creature must have weathered extreme shifts in climate, researchers report online July 23 in the Proceedings of the National Academy of Sciences. Simulations of how the DNA changed over time suggest that polar bear populations rose and fell with the temperature. After thriving during cooler times between 800,000 and 600,000 years ago, the bears seem to have suffered a genetic bottleneck and crashed after a warmer period that started about 420,000 years ago.

Whether the Arctic icon will survive today?s rapid warming remains an open question. ?Even if this species has for sure experienced dramatic climatic changes before, that does not mean it?s safe today,? says Charlotte Lindqvist, an evolutionary biologist at the University at Buffalo in New York.

Lindqvist and colleagues had previously dated the emergence of the polar bear to no more than 150,000 years ago (SN: 3/27/10, p. 14). But that research relied on a single fossil containing mitochondrial DNA, genetic material inherited from the mother. In April, the origin was pushed back to 600,000 years ago by Frank Hailer, an evolutionary biologist at the Biodiversity and Climate Research Centre in Frankfurt (SN: 5/19/12, p. 12). His team examined more than 9,000 letters in nuclear DNA (derived from both parents) of modern bears.

The new study provides an even clearer picture, says Lindqvist, because it looks at the entire genetic blueprints of 23 modern polar bears. ?Lindqvist and colleagues spelled out more than 2.5 billion letters in the creatures? nuclear DNA and identified more than 13 million points of comparison.

But the date in the new study was calibrated using the rate at which mutations appear in the DNA of primates, Hailer says. ?They?re assuming that the genetic clock in bears ticks at the same pace as that in primates.?

Even as it establishes an ancient pedigree for the polar bear, the new research blurs the lines between the species and its darker cousins. Isolated brown bears living in Alaska?s Admiralty, Baranof and Chichagof islands share between 5 and 10 percent of their DNA with polar bears, Lindqvist?s team found. A previous study found that ancient brown bears in Ireland also shared much mitochondrial DNA with their comrades to the north.?

So although polar bears and brown bears separated long ago, they seem to get together every now and then for a fling ? perhaps when the weather warms, sending polar bears southward and brown bears northward. And that interbreeding may in itself be a threat.

?If you get more and more hybridization, you may lose whatever makes polar bears special,? says Ceiridwen Edwards, a geneticist at the University of Oxford in England.

Applications include studying single cells that form malignant tumors

July 22, 2012, New York, NY and Stockholm, Sweden Only by viewing a Seurat painting at close range can you appreciate the hidden complexities of pointillism small, distinct dots of pure color applied in patterns to form an image from a distance. Similarly, biologists and geneticists have long sought to analyze profiles of genes at the single cell level but technology limitations have only allowed a view from afar until now.

Research published in the July 22 issue of Nature Biotechnology, shows for the first time that a novel genomic sequencing method called Smart-Seq can help scientists conduct in-depth analyses of clinically relevant single cells. Smart-Seq has many possible applications, including helping scientists to better understand the complexities of tumor development. This is vitally important as many clinically important cells exist only in small numbers and require single cell analysis. The study was conducted by a team of researchers from the Ludwig Institute for Cancer Research, the Karolinska Institutet in Sweden, the University of California, San Diego and Illumina Inc.

"While our results are preliminary, we showed that it is possible to do studies of individual, clinically relevant cells," says biomedical scientist Rickard Sandberg, researcher at the Ludwig Institute for Cancer Research and principal investigator at the Department of Cell and Molecular Biology, Karolinska Institutet. "Cancer researchers around the world will now be able to analyze these cells more systematically to enable them to produce better methods of diagnosis and therapy in the future."

Previous research showed that it is common for one gene to give rise to several forms of the same protein through different cut-and-paste configurations of its raw copy. The phenomenon, known as splicing, means that cells from the same tissue are not so homogenous as previously thought.

The research team has now taken its study a step further and developed a method for the complete mapping of the gene expression of individual cells. In showing which genes are active, it is now possible to accurately describe and study differences in gene expression between individual cells from the same tissue.

"Scientists have been waiting for a long time for such a method to come along, but technical limitations have made it difficult to produce a sufficiently sensitive and robust method," says Dr. Sandberg. "The method has several areas of applications including cancer research where it can be used to study which cell types form cancer tumors in individual patients."

In the study, scientists studied tumor cells in the blood system of a patient with recurring malignant melanoma. Once they had identified the tumor cells in a regular blood test, the team used Smart-Seq to analyze their gene expression. By using this method, researchers could show that the tumor cells had activated many important membrane proteins that are understood to be responsible for their ability to evade the body's monitoring system and spread in the blood or lymph.

The study was conducted with the support of several funding bodies, including the European Research Council, the Swedish Research Council, the Foundation for Strategic Research, the ke Wiberg Foundation and the National Institutes of Health (NIH).
