My real estate agent asked for my loan officers ... - Zillow Real Estate ...

As a Broker and sales manager of 60+ agents, I have seen many examples regarding your concerns.

As a buyer, its important that you choose a real estate agent that will represent you to the end. ?Not just an agent to write an offer then go away...waiting for their commission check to arrive in the mail.

Here is what I know and I hope it helps.

When I represent a client as a buyer, I require that they get a pre-approval from their lender prior to us submitting an offer because in a competitive market, the selling agent will require this. ?This letter will also have the lenders information on it for both agent to identify. ?

Keep in mind the lender will need the agents information as well, as we are all on the same team...to get you into your home as quickly and with the least amount of delays.

believe it or not, many lenders that represent our buyers are not the best a sticking to a schedule and its your agents job to help you by communicating for updates to help keep everyone on time. ?If the sale was due to close and the two never communicated...who's fault would it be if it did not close on time? ?The buyer simply wants the home. ?

I have cases where the appraisal should have been ordered weeks ago and the lender forgot this simple task. ?The lender is responsible for ordering the appraisal, the appraiser (most of the time) will contact the buyer or selling agent for access to the property...Some lenders may not be 100% honest with all the facts and at the 12th hour the agent finds out that the buyer is still waiting for a credit issue to be cleared...if the agent knew in advance there could have been a time extension filed, saving the buyer much grief. ?Deals have been lost because of poor communication between lender and agent because of this.

My opinion is let your agent do his job and cooperate with him...it's only to help you close your sale on your new home.

Your lender is not allowed to give them any financial information about you without your permission, so basic communication is harmless.

(AP) ? This was supposed to be the weekend for the NHL All-Star Game at Nationwide Arena.

Instead, the Chicago Blackhawks flaunted their own constellation of stars.

Patrick Kane had yet another multipoint game with two assists, Jonathan Toews scored the game-winner early in the third period and Corey Crawford had 24 saves to help Chicago match the best start in franchise history with a 3-2 victory Saturday night over the Columbus Blue Jackets.

The only other time the Blackhawks began a season 5-0-0 was 1971-72.

"That was one of those games where maybe we didn't play our best hockey like we've seen in the last five games, but as a team it doesn't matter who goes out there you've got to find a way to win," Toews said. "And we did that."

Crawford, who won for the fourth time this season, was solid all night but particularly when the Blackhawks were a man down. They killed all five penalties.

"I feel good, I feel focused," Crawford said. "The puck looks pretty big right now. Also, everyone's making the effort to play defense. It's showing in the first bunch of games ? guys are coming back to help out and that helps us get to offense after that."

Badly outplayed at the outset, the Blackhawks played methodical, poised and unhurried hockey all night. Even when down 1-0, it seemed only a matter of time before they collected themselves and took control.

"Finding ways to win is important," coach Joel Quenneville said. "You're not going to be great every night or your best every night. Columbus played a hard-working game, working harder than us tonight. But we got key saves from (Crawford) tonight and that helped us."

The All-Star Game, of course, was cancelled by the 119-day lockout that reduced the season to 48 games for each team over 99 days.

Steve Mason held his own with 21 saves for the Blue Jackets, who lost their third in a row. A goal by Derick Brassard was waved off in the second period when the officials ruled Nick Foligno interfered with Crawford. That decision caused a sellout crowd of 18,381 to boo throughout the game.

"You never know how a game's going to end up," Blue Jackets coach Todd Richards said. "(The goal being disallowed) certainly changed the course of the game. At the time, we were down 2-1. It's a huge play. He (referee Dan O'Rourke) makes the call, he saw what he saw. There's nothing we can do once he makes the call."

On the power play after Jamal Mayers went to the penalty box for unsportsmanlike conduct, Brassard's slap shot from the point beat Crawford. But O'Rourke immediately waved off the goal. Replays showed Foligno's right skate was in the crease, although there was no apparent contact between him and Crawford.

Between periods, Foligno said O'Rourke told him that the goal was disallowed because "I had bumped (Crawford) and didn't give him time to reset."

The crowd booed lustily at every opportunity the rest of the night.

Quenneville said later that replays showed clearly that it should have been a tying goal.

Mark Letestu gave Columbus a 1-0 lead and Artem Anisimov scored late to make it interesting for the Blue Jackets, who have been outscored 12-3 in their losing skid.

Toews, off of Kane's second assist of the night, put the Blackhawks up two goals 6:35 into the third after a turnover in the Chicago zone. Letestu's pass was deflected by Marian Hossa with Kane retrieving it. He fired a blind, quick pass to Toews who was all alone behind the defense. Toews faked left, then right, before flipping the puck past Mason for his third of the year and a 3-1 lead.

Anisimov backhanded in Brandon Dubinsky's wraparound attempt with 2:19 left in regulation, but the Blue Jackets could not get the equalizer.

Kane now has more than one point in four of the five Chicago games and has two goals and seven assists.

"You can tell he's good ol' Kaner," Toews said. "He's going to work hard and make plays."

The Blue Jackets could only think about the goal that didn't count.

"Overall everybody worked hard," Mason said. "It's unfortunate. I'm not sure what the call was on that second goal for us but the guys kept working and we just came up a little short."

NOTES: Chicago won all six meetings against the Blue Jackets last season and is now 20-12-4 all-time at Nationwide Arena. ... The Blackhawks improved to 4-0-0 on the road this season. ... The Blue Jackets were without RW Cam Atkinson, who suffered a lower-body injury in camp. He may be out at least a week. ... Hossa has 35 points (17 goals, 18 assists) in 29 career games against Columbus while Kane has 34 points (12 goals, 22 assists) and Toews 33 (14 goals, 20 assists) in 31 games against the Blue Jackets.

Deadly smoke, lone blocked exit: 230 die in Brazil

SANTA MARIA, Brazil (AP) ? A fast-moving fire roared through a crowded nightclub in southern Brazil early Sunday, within seconds filling the space with flames and a thick, toxic smoke that killed more than 230 panicked partygoers who gasped for breath and fought in a stampede to escape.

It appeared to be the world's deadliest nightclub fire in more than a decade.

Firefighters responding to the blaze at first had trouble getting inside the Kiss nightclub because bodies partially blocked the club's entryway.

Witnesses said a flare or firework lit by band members started the blaze in Santa Maria, a university city of about 260,000 people. Officials at a news conference said the cause was still under investigation ? though police inspector Sandro Meinerz told the Agencia Estado news agency the band was to blame for a pyrotechnics show and that manslaughter charges could be filed.

Television images showed black smoke billowing out of the Kiss nightclub as shirtless young men who had attended a university party joined firefighters using axes and sledgehammers to pound at windows and hot-pink exterior walls to free those trapped inside.

Bodies of the dead and injured were strewn in the street and panicked screams filled the air as medics tried to help. There was little to be done; officials said most of those who died were suffocated by smoke within minutes.

Within hours a community gym was a horror scene, with body after body lined up on the floor, partially covered with black plastic as family members identified kin.

Outside the gym police held up personal objects ? a black purse, a blue high-heeled shoe ? as people seeking information on loved ones looked crowded around, hoping not to recognize anything being shown them.

Guido Pedroso Melo, commander of the city's fire department, told the O Globo newspaper that firefighters had a hard time getting inside the club because "there was a barrier of bodies blocking the entrance."

Teenagers sprinted from the scene after the fire began, desperately seeking help. Others carried injured and burned friends away in their arms. Many of the victims were under 20 years old, including some minors.

"There was so much smoke and fire, it was complete panic, and it took a long time for people to get out, there were so many dead," survivor Luana Santos Silva told the Globo TV network.

The fire spread so fast inside the packed club that firefighters and ambulances could do little to stop it, Silva said.

Another survivor, Michele Pereira, told the Folha de S. Paulo newspaper that she was near the stage when members of the band lit flares that started the conflagration.

"The band that was onstage began to use flares and, suddenly, they stopped the show and pointed them upward," she said. "At that point, the ceiling caught fire. It was really weak, but in a matter of seconds it spread."

Guitarist Rodrigo Martins told Radio Gaucha that the band, Gurizada Fandangueira, started playing at 2:15 a.m. "and we had played around five songs when I looked up and noticed the roof was burning"

"It might have happened because of the Sputnik, the machine we use to create a luminous effect with sparks. It's harmless, we never had any trouble with it.

"When the fire started, a guard passed us a fire extinguisher, the singer tried to use it but it wasn't working"

He confirmed that accordion player Danilo Jacques, 28, died, while the five other members made it out safely.

Police Maj. Cleberson Braida Bastianello said by telephone that the toll had risen to 233 with the death of a hospitalized victim. He said earlier that the death toll was likely made worse because the nightclub appeared to have just one exit through which patrons could exit.

Survivors said security guards briefly tried to block people from exiting the club. Brazilian bars routinely make patrons pay their entire tab at the end of the night before they are allowed to leave.

Officials earlier counted 232 bodies that had been brought for identification to a gymnasium in Santa Maria, which is located at the southern tip of Brazil, near the borders with Argentina and Uruguay.

Federal Health Minister Alexandre Padhilha told a news conference that most of the 117 people treated in hospitals had been poisoned by gases they breathed during the fire. Only a few suffered serious burns, he said.

Brazil President Dilma Rousseff arrived to visit the injured after cutting short her trip to a Latin American-European summit in Chile.

"It is a tragedy for all of us," Rousseff said.

Most of the dead apparently were asphyxiated, according to Dr. Paulo Afonso Beltrame, a professor at the medical school of the Federal University of Santa Maria who went to the city's Caridade Hospital to help victims.

Beltrame said he was told the club had been filled far beyond its capacity during a party for students at the university's agronomy department.

Survivors, police and firefighters gave the same account of a band member setting the ceiling's soundproofing ablaze, he said.

"Large amounts of toxic smoke quickly filled the room, and I would say that at least 90 percent of the victims died of asphyxiation," Beltrame told The Associated Press by telephone.

"The toxic smoke made people lose their sense of direction so they were unable to find their way to the exit. At least 50 bodies were found inside a bathroom. Apparently they confused the bathroom door with the exit door."

In the hospital, the doctor "saw desperate friends and relatives walking and running down the corridors looking for information," he said, calling it "one of the saddest scenes I have ever witnessed."

Rodrigo Moura, identified by the newspaper Diario de Santa Maria as a security guard at the club, said it was at its maximum capacity of between 1,000 and 2,000, and partygoers were pushing and shoving to escape.

Santa Maria Mayor Cezar Schirmer declared a 30-day mourning period, and Tarso Genro, the governor of the southern state of Rio Grande do Sul, said officials were investigating the cause of the disaster.

The blaze was the deadliest in Brazil since at least 1961, when a fire that swept through a circus killed 503 people in Niteroi, Rio de Janeiro.

Sunday's fire also appeared to be the worst at a nightclub since December 2000, when a welding accident reportedly set off a fire at a club in Luoyang, China, killing 309.

In 2004, at least 194 people died in a fire at an overcrowded nightclub in Buenos Aires, Argentina. Seven members of a band were sentenced to prison for starting the flames.

A blaze at the Lame Horse nightclub in Perm, Russia, killed 152 people in December 2009 after an indoor fireworks display ignited a plastic ceiling decorated with branches.

Similar circumstances led to a 2003 nightclub fire that killed 100 people in the United States. Pyrotechnics used as a stage prop by the 1980s rock band Great White set ablaze cheap soundproofing foam on the walls and ceiling of a Rhode Island music venue.

The band performing in Santa Maria, Gurizada Fandangueira, plays a driving mixture of local Brazilian country music styles. Guitarist Martin told Radio Gaucha the musicians are already seeing hostile messages.

"People on the social networks are saying we have to pay for what happened," he said. "I'm afraid there could be retaliation".

I Don?t Drink

I don't drink alcohol the way other people don't eat oysters, or don?t start the day with a cup of coffee. I don't drink because I don't like it, I never have. But the difference between me and people who don?t eat oysters is that I have to explain my choice?and I've had to for 20 years.

Alcohol isn?t just a drink, it?s a rite of passage. Forget getting your period, or your voice finally breaking?being an adult in North America means being legal. The irony being that alcohol is essentially childhood in a bottle. For a few bucks, you get a trip back to the carefree days of slurred speech, impaired balance and nonexistent inhibitions. Who?d turn down a bargain like that?

"You just don't like it or ..." is generally the response I get when I abstain. The ellipsis, along with the furrowed brow, covers everything from a bad case of alcoholism to a bad case of religious zealotry. A female friend of mine whose uncle owns a bar and who recently stopped drinking, added, "people always ask me if I'm pregnant, which makes me want to have a drink."

It?s not that I haven?t tried alcohol. I have. I've tried it more times than I would ever try anything else I know I don't like. And I still don't like it. My mom recently told me that when I was a toddler she was once in the bath with her eyes closed, and when she opened them she found her glass of Bailey's gone. Apparently, when she asked where it went, I yelled from the hallway, "Chocolate milk!" (Despite that bathtub cocktail, my parents barely drank. ?Neither mom nor dad were particularly big drinkers,? my brother recently reminded me as we both considered why neither of us drink. ?They tended not to keep alcohol in the house, so it's not something we associated with adulthood or anything else.?) In addition to that premature shot of Bailey?s, I?ve given beer, wine, and hard liquor a chance. And I still don?t like to drink.

In high school, I lied about why I never drank. "I don't want to lose control,? I said. The truth?I don?t want to be like you?would no doubt have been less palatable. I remember one kid, eyes filled to the brim with Molson Canadian, asking me, "Don't you want to know what's going on in my head right now?" And, well, the joke kind of wrote itself. According to my best friend at the time, who I consulted for this piece, I spent my teen years looking "uncomfortable and a little bit disgusted" with everyone. "I guess I felt like I was disappointing you," she said. "But I was like, 'Hrm, I'm gonna go get drunk anyway.' "

I grew out of the disappointment but not the disgust. When I finally elbowed my way past the high school meat heads and into university (more meat heads!), I still couldn?t stomach the flavor of fermented what-have-you enough to benefit from the euphoria it afforded. These days, I use that excuse more than any other because it seems to be the one that everyone can understand. In an episode of the U.K. sitcom Peep Show, for instance, socially awkward anti-hero Mark Corrigan, struck with a case of insomnia, bemoans having to suck down fermented grain mash instead of something a little sweeter. "Ahh! Horrible whiskey," he says. "Still, midnight down the bar, can?t exactly have a chocolate milkshake, can I?"

I am the midnight milkshake drinker. According to my boyfriend, I regularly replace alcohol with food. Apparently I ask to see the dessert menu every time I accompany him to the bar. Presumably, the drunker he gets, the fatter I get. When I asked if he ever wished I drank, he emphatically denied it. "I see it as a bonus that I don't have to worry that you are choking on your own vomit down an alleyway when you're not back 'til late," he said. "I just know you've collapsed in a cake shop." (I never said I had self-control?sugar is my drug of choice.)

Green: Nebraska Governor Approves Keystone XL Pipeline Route

Gov. Dave Heineman of Nebraska approved a revised route for the Keystone XL pipeline through Nebraska on Tuesday, brushing aside vocal opposition from some citizen groups and putting final approval of the pipeline project squarely in the hands of the Obama administration.

The decision came a day after President Obama made an assertive pledge in his inaugural address to tackle climate change in his second term. Opponents of the pipeline, which would bring heavy crude oil from tar sands formations in Alberta, Canada, to refineries on the Gulf Coast, say that its extraction and consumption will significantly worsen global warming and that Mr. Obama?s decision will be a test of his intentions.

Governor Heineman, a Republican, said in a letter to Mr. Obama and Secretary of State Hillary Rodham Clinton that his state?s review found that the new route avoided sensitive lands and aquifers. Mr. Obama had rejected the previous route last January on the grounds that construction of the pipeline threatened Nebraska?s Sand Hills region and that a spill could contaminate the critical Ogallala Aquifer.

Mr. Heineman said that the pipeline?s operator, TransCanada, had assured him and state environmental officials that the chances of a spill would be minimized and that the company would assume all responsibility for a cleanup in case of an accident.

The State Department, which must review the 1,700-mile pipeline because it crosses an international border, is in the final stages of preparing an environmental-impact statement on the project. An earlier version found that the project would have minimal adverse effects along its route.

The American Petroleum Institute, a strong advocate of the project, applauded Nebraska?s action, saying that it removed a critical hurdle to completion of the pipeline.

?With the approval from Nebraska in hand, the president can be confident that the remaining environmental concerns have been addressed,? said Marty Durbin, the oil lobby?s executive vice president. ?We hope President Obama will finally greenlight KXL as soon as possible and get more Americans back to work.?

Jane Kleeb, director of Bold Nebraska, a citizens? advocacy group that is staunchly opposed to the pipeline, assailed Mr. Heineman?s move. ?On the one hand, it?s shocking the governor would turn his back so clearly on the Ogallala Aquifer and property rights in our state,? she said. ?However, given what the president said yesterday about climate change, what?s clear is that the governor has made a very big political decision.?

Ms. Kleeb said that if the president was indeed serious about addressing climate change, he had no choice but to reject Keystone XL.

Last week, a coalition of environmental groups, including the Sierra Club and 350.org, called on President Obama to kill the project, saying it would bring a rapid expansion of tar sands mining and greatly contribute to greenhouse gas emissions.

?From our perspective, this has always been about the climate, and it has always been about the president,? said Daniel Kessler, a spokesman for 350.org, said on Tuesday. ?It?s unfortunate that the governor decided to do what he did. But ultimately this will come down to President Obama.?

Mr. Kessler said that the group was intent on holding Mr. Obama to his vow to address climate change in his inaugural speech. His group is planning a large rally in front of the White House on Feb. 17 to urge the president to reject the pipeline, he said.

?The Keystone XL pipeline isn?t dead yet,? 350.org and the Sierra Club said in a statement. ?If President Obama is serious about tackling climate change, he needs to reject KXL once and for all. And we?re not going away until that happens.?

Rescue Groups Warn: Keep Your Pets Safe In The Cold ? CBS Detroit

DETROIT (CBS Detroit)?- Baby, it?s not just cold outside, it?s downright frigid. And if it?s too cold for you to spend an extended period of time outside, it?s also too cold for dogs and cats.

As temperatures dropped below the freezing mark, the Michigan Humane Society and Detroit Dog Rescue reminded Detroit dog owners it?s their responsibility to ensure their pets are safe and comfortable.

?Extreme cold temperatures can be very dangerous for dogs outside,? said Rodney Stewart, field operations agent for Detroit Dog Rescue.

Don?t believe the old adage about dogs being protected by fur coats in any weather ? because their paws aren?t protected, nor are their thin-skinned underbellies.

The Dog Rescue?s?Dante Dasaro stressed that, if your dog is an outside pet, the position of the dog house is important.

?If by all means at all possible, it should be up against the home, with the opening of the dog house facing away from the wind. And by putting it up against the house, you actually will get some radiant heat from the home that will help warm the dog house,??Dasaro said.

He said there should also be a lot of insulation.

?You want to put down straw, and not hay, because straw is actually treated to keep down mold and bacteria,? Dasaro explained. ?So when you do that you want to fill up the dog house to about half the capacity of the dog house to give it a nice pillow so that the dog is actually suspended on the straw and not touching the floor of the dog house.?

He said you should change the straw out every month.

The Humane Society is currently offering free straw for pets at the MHS Detroit Center for Animal Care, 7401 Chrysler Drive, between 10 a.m. to 5 p.m. Mondays through Saturdays, and from 10 a.m. to 7 p.m. on Wednesdays.

Here are tips to make sure your pets are comfortable through the dark, chilly days of winter.

1.?Doggie Fitness & Relief?? Dogs by nature love the outdoors.? They love to play, rip, run, sniff and of course take potty breaks.? However, during cold weather months pet owners need to pay more attention to the time spent outside.? Pet owners should limit their dogs? time outside to reduce exposure.? When outdoors, dress your dog with an insulated vest, sweater and doggie boots to protect their paws and core.

2.?Nutrition & Adequate Hydrations?? Dogs that spend most of their time outdoors may need more calories to maintain their energy level in cold weather.? Always check with your vet regarding all changes to your dog?s diet.? It?s also important to make sure your dog has adequate water outside.? Keep it fresh and in a plastic bowl (avoid metal) to prevent it from freezing ? contrary to popular belief dogs cannot break ice in a water bowl and you do not want them licking ice or eating snow as a way to hydrate.? Gold Almost Ready to MoveThere are a lot of stocks that are doing well in this market. Because there is no uniformity to business conditions in both the U.S. economy and the rest of the world, I?m making a conscious effort to attribute less weight to the major stock market indices and more to individual companies and their specific business conditions. I hate to say it, but the main stock market indices can be quite misleading, and one company can skew the index (like Apple Inc. [NASDAQ/AAPL] when it was at its high).

The way I look at the stock market and the economy today is with very low expectations. If U.S. gross domestic product (GDP) can grow faster than the rate of inflation, then that?s a good accomplishment. I hope the Federal Reserve is right with its prediction of 2.5% in U.S. GDP growth in 2012 and 3.5% in 2013. Of course, these forecasts change all the time, so it doesn?t mean much.

So, while the S&P 500 index is trading around its five-year high, plenty of stocks are doing much better than the index. (See ?Earnings Picture Starts off Bright with Oracle.?) 3M Company (NYSE/MMM) just hit an all-time record high on the stock market. This stock has had a few down years, but it has basically been going straight upward since 1982. Consider Johnson & Johnson (NYSE/JNJ). This position just hit an all-time high on the stock market. It was kind of slow over the last 12 years, only doubling not including dividends. The stock is up seven-fold since 1994, not including dividends.

Then there?s my favorite, Colgate-Palmolive Co. (NYSE/CL). This stock is very close to breaking its all-time stock market high that it set last October. As is usually the case with this stock, it was worth buying when it was down the last few months. The company?s stock chart is below:

There?s lots of great action in this market; don?t let the main stock market indices fool you.

But now, if you would allow me to change topics, the one thing that?s been on my mind a lot lately is gold. I can?t escape this gut feeling that gold is almost ready to move.

On the stock market, gold stocks have mostly done terribly over the last 12 months, even though the spot price only retreated somewhat. We?ve been in a major gold price consolidation for about a year and a half, which is about the same duration as the last two big price consolidations. Goldman Sachs recently lowered its gold price target for this year and next. But a lot of Wall Street analysts are still talking about $2,000-an-ounce gold sometime this year. I am one of them.

A large part of the poor stock market performance from gold stocks (both large and small) over the last year is because costs have been going up?way up, in fact, and margins are much thinner. It was only a few years ago that anything over $1,000 an ounce was pure gravy for most gold producers. The latest industry-wide cash cost analysis I read suggested that $1,400 was the average breakeven point, so this doesn?t leave a lot of room for exceptional earnings.

And this is just one of the big risks with resource investing. There is just so much beyond your control as a stock market investor. Which is why, right now, in the environment we have for gold, I think investors wanting to play gold should consider trading right off the spot price, rather than individual gold stocks.

The sovereign debt crisis in Europe still exists, demand for gold in India and China is strong, and gold production is about to get squeezed, due to costs. We?re not there yet, but gold prices are almost ready for a major breakout.

Helpful Advice When Filing For Bankruptcy - Options Finance

Many people find themselves feeling unworthy, depressed or frightened when going through bankruptcy. Do not let your emotions get the best of you, you can clear up your life and stop worrying as much. They think they are stuck, but they really aren?t, and neither are you, thanks to the following tips.

Your asset might even be safe, in certain cases. It doesn?t matter how things play out in the grand scheme, though. If you hide your assets, you will face serious consequences.

Think carefully about which kind of bankruptcy will work best for you. There are various forms of bankruptcy. Do your research and understand each type before you make a final decision about which one to file. Once you fully understand the different types of bankruptcy, consult a bankruptcy awyer to get sound advice.

It?s important to exercise discretion with any new credit you apply for after a bankruptcy filing. Some lender may offer credit cards to those who have filed for bankruptcy and want a new start. These usually are accompanied by exorbitant interest rates. So, you need to be disciplined and hold off getting these high interest rate loans which will only bring you back to where you were before.

It is important to consult with an attorney who specializes in bankruptcy if you are headed toward bankruptcy. A reputable lawyer can explain the bankruptcy process and be your representative in court on your behalf. Your lawyer also knows how to properly file the paperwork and can answer any questions that you have.

Filing bankruptcy may be better for your credit than letting several bills go into collections. Some creditors will settle for lesser amounts on debt, or help you work out a more affordable payment plan. You can help your credit score this way, not to mention save some money. Before filing, think about a loan for debt consolidation.

Be warned that after your bankruptcy, you may stand out as a leper to credit institutions. You may be unable to get a simple credit card. In this event, you should attempt to apply for a secured card or two. This will show other people that you?re serious when it comes to having your credit record in order. After using a secured card for a certain amount of time, you might be offered an unsecured card once again.

Filing for bankruptcy is hard on anyone, and can cause extreme amounts of stress. Working with a good bankruptcy lawyer can help make the process a lot smoother and less stressful for you. Don?t let cost be the sole factor in who you hire. There is no need to use an expensive attorney. The important thing that you must do is to get a good attorney. Ask for referrals from folks who have filed and check reputations with the BBB. You could also sneak into court to watch a real live bankruptcy proceeding to see how that attorney handles the situation.

If you file for Chapter 7 bankruptcy, do not assume that your debts will just be dismissed. Some debts might have to be reaffirmed. That means you need an entirely new agreement for paying them back, and other debts are simply not able to be discharged. Chapter 7 does not eliminate child support payments, alimony, or court-imposed fines.

After reading, you can see you do have options available, and bankruptcy does not signal the end of the world. In the beginning, it can be hard, but there is no reason why bankruptcy should defeat you. Remember these tips so you can dig your way out of debt.

One of the many quirks in renewable energy research is the amount of energy it takes to conduct the research. A senior colleague of mine likes to joke that marine renewable energy, in particular, is very likely to run at a deficit of watts for some years to come.

He is mostly thinking of the jet fuel used by people flying around in airplanes to meetings and such, but he would do well to consider the batteries in all of my instruments. The instruments we will deploy to measure turbulence in Chacao Channel, Chile, and assess the prospects for turbines to generate electricity from currents, are all autonomous; they are powered internally by batteries and record data to flash memory. The obvious choice for battery type is lithium, because of higher energy density and steady voltage during discharge.

The lithium battery is not without problems, however. Lithium is a hazardous material, both by regulation and by reality. Early in graduate school I had a near miss with a lithium battery inside an instrument case that leaked and filled with seawater. Lithium + water = explosion.

Now, lithium is causing problems again (and not just for Boeing). The last report on our shipment of equipment to Chile was ?arriving in port, all well.? The update now, 24 hours before we were to board a plane, was not well at all.

Apparently the port is not licensed to store hazardous material, like lithium batteries, while waiting for the shipment to clear customs. Despite having arranged our shipping details months in advance, including completing reams of ?hazmat? paperwork, the port was unprepared for our shipment?s arrival and so they simply did not unload it.

That?s right: all of our equipment, including said batteries (which constitute a tiny part of what we shipped), is still on the cargo ship. And that cargo ship set a course for Peru. As an old captain I used to sail with would say, ?well, now, that?s a pickle.?

The ultimate irony in this story pertains to the lithium itself: much of it comes from Chile to begin with. Some estimates put Chilean production at 40 percent of the global total.

The shipping company has assured us that the cargo ship will be back in Chilean waters soon, and they will try again to deliver it. I was hoping for a more definitive word than ?try,? but perhaps that?s just a problem in translation.

For now, we have postponed our flights and begun shuffling calendars to make room for the same trip ? just a week or two later.

We have a contingency plan, of sorts. We have a few spare instruments still in the lab in Seattle, complete with standard alkaline batteries (which are not designated as hazardous material). We can hand-carry these instruments on the plane with us.

When we get to Puerto Montt, we can build a mooring from scratch with whatever we can source locally. It?s a sizable fishing community, so we should be able to find plenty of shackles, line, chain and anchors. It might not be pretty, but if that cargo ship never makes it back to Chile, it should work.

In the meantime, I am left to contemplate those lithium batteries. We could have gone with alkaline batteries instead to begin with and just planned to collect less data. I could have been less greedy, using less energy for less time. Perhaps that?s an obvious choice for a renewable energy project.

Power density is the Achilles? heel of all renewable energy generation. The power available from the sun, wind, and ocean is diffuse. The standard metric is watts per square meter. There are plenty of watts to be had, certainly, but it will take a lot of square meters to get those watts.

Fossil fuels, by contrast, are highly concentrated (a result of cooking underground for millions of years). Batteries are concentrated, too. Neither lasts forever. A pickle, indeed.

Weidmann says ECB is not the only crisis manager: paper

(Reuters) - Bundesbank chief Jens Weidmann warned against relying on the European Central Bank as the only crisis manager, telling a Finnish newspaper that its bond buyback program me was risky.

"Central banks in recent years have been pulled into the role of a crisis manager. Some think that central banks are the only able ones. I consider this thinking wrong and dangerous," Weidmann, also ECB Governing Council member, told Helsingin Sanomat in an interview.

His comments were published in Finnish on the newspaper's website on Sunday.

Weidmann reiterated his criticism of the ECB's program of buying bonds on the secondary market of highly indebted euro member states.

"The program can bring considerable risks to the monetary policy. Those risks now have to be limited and prevented," he was quoted as saying.

Weidmann said the greatest risk is that the cheaper financing takes away the incentive for fiscal reform.

"Monetary policy can only buy more time. It is like a painkiller which will not erase the reasons but can cause risks and side effects," he said.

He also warned against Europe depending on the ECB to supervise banks in the banking union.

"That would mask the conflict of interest between the supervision task and monetary policy. I hope that the ECB would only serve as a helper," he said.

Microsoft working on a fix for Halo 4 SmartGlass issues, set to arrive in 'the coming weeks'

Microsoft's SmartGlass and Microsoft's Halo 4 apparently aren't quite getting along on Windows Phone 8 devices. Using SmartGlass, Halo 4 players can normally access their stats and other info about their android supersoldier using the long-established Waypoint service -- except for Windows Phone 8 users, apparently. A forum thread dating back to Halo 4's November launch highlights the issue -- as Xbox.com forum user "Scion Eon" puts it: "Whenever I try to log into SmartGlass on my phone while playing Halo 4, I am immediately greeted with a message that says 'Your device is missing certain required features.'" As it turns out, Mr. Eon isn't the only one experiencing said connectivity issues -- specific to Windows Phone 8 devices -- and Microsoft's aware of the situation.

"We are aware that there is an issue with the Xbox SmartGlass experience for 'Halo Waypoint' on Windows Phone 8 devices, which may prevent users from accessing Halo 4 player stats," a Microsoft rep told us this afternoon. Thankfully, Redmond's also taking care of a solution. "We are actively working on a fix and expect to have a solution within the coming weeks. We appreciate your patience as this gets resolved and apologize for any inconvenience this causes," the statement reads. Of course, should you want to access Halo 4's Waypoint functionality on SmartGlass before that fix, you can always use Microsoft's competitor's devices. But then who'd do that?

These three to choices are among the most expensive games sold in Australia, that is why many prefer to bring them in to avoid costly consequences. Because of the distribution, games which could cost around 50 to 60 USD in North America would probably cost more than that here. If you already have these games, it would be more economical and practical to pack them prior to your move to Australi and any other countries across the globe.

The charitable deduction wasn?t dumped off the fiscal cliff, but it was dented in the new law passed by Congress. That bill does not include cuts to your charitable tax deduction that are as big as President Obama proposed in his last budget, but it does trim deductibility for donors.

The President and House Minority Leader Nancy Pelosi insisted the new law include the so-called Pease provision, a limitation on deductibility that was abolished under President Bush?s now-expired tax reforms.

As with many tax law details that keep lobbyists? hourly rates high, the Pease provision is complicated. Here?s an oversimplified summary: Your itemized deductions (including charitable deductions) will be diminished by an amount equal to 3 percent of the income you earn above a certain threshold: $250,000 for persons filing as individuals, $300,000 for married persons filing joint returns.

The most important stat is the swag Congress and the President expect to receive by cutting deductions: $152 billion over a decade.

For more precise details on the Pease provision, consult the best explanation available, courtesy of the Alliance for Charitable Reform (ACR). The Alliance also released this comment:

ACR is pleased that the charitable deduction was preserved in this agreement.? Throughout these negotiations,?ACR members and other representatives of the philanthropic community have educated Congress about the value of charitable giving all across our country, especially for those who are in greatest need of services.? The charitable deduction has a direct and indisputable influence on charitable giving, and preserving it has been central to our efforts in Washington.?
????? However, ACR is disappointed that the PEASE provision was made permanent in this agreement, which will progressively limit deductions, including the charitable deduction. We encourage members of Congress and the President to continue to preserve the charitable deduction and revisit PEASE as it relates to charitable giving as we move forward into both tax reform and measures to address the federal deficit.

As ACR?s last paragraph indicates, the charitable deduction?s status remains quite unsettled. Republican and Democrat leaders, including the chairmen of the House Ways and Means Committee and the Senate Finance Committee, all predict much more tax wrangling will soon occur. No one knows what that will mean for charitable deductions.

Resurrecting the Death Tax

Another provision in the fiscal cliff bill that will affect major donors: The estate tax, aka the ?death tax,? has been resurrected. It is now permanently set at a rate of 40 percent after the first $10 million, despite the fact that Americans regularly tell pollsters they find such a tax immoral, even if it won?t affect them.

Also of interest to donors are the permanent increases in tax rates for capital gains and dividends: 20 percent for those who earn over $400,000 (as individuals) or $450,000 (as joint married filers).

As I argued previously, seconding Kim Dennis of the Searle Freedom Trust, ?economic growth and wealth creation? are vital to the charitable sector?s health, which means punitive taxes will harm charities and wealth creators alike.

Too bad so few in the tax-exempt world ever stop to think about that fact. On the other hand, recall the surprising criticisms of the President?s attacks on the charitable deduction that Emmett Carson made last year. Carson, who is one of the most interesting philanthropic voices on the left, is a past board chair of the Council on Foundations and currently heads the Silicon Valley Community Foundation. He made his criticisms first at a Council on Foundations meeting, then to?the?New York Times:

We now have a President, a former community organizer, who does not value the charitable deduction. What he?s saying is that, left to its own devices, government can spend those dollars better than philanthropists.

Quoting Carson, I blogged on how odd that particular criticism sounds coming from the left, which is usually oblivious to all the ways that an obese government harms the wellsprings of both private wealth and civic ties.

Others Weigh In

Rick Cohen, another of the left?s most interesting voices in philanthropy, comments on the fiscal cliff bill here. (He doesn?t mind the Pease pilfering of the wealthy, but rightly complains that the middle class and? low-income workers will take a hit because the new law ends the payroll tax ?holiday? that has been lowering the ?extraordinarily regressive? taxes we pay into Social Security. Now if only Cohen would ponder Social Security a bit more deeply. He might consider how this? pillar of the welfare state not only lives on regressive taxes but also was never designed to help only the poor but rather to enmesh the middle and upper classes into federal redistribution of income, which explains why it (like many government programs) sends so much money to persons?who don?t need it. And the program also erodes civic ties by encouraging families and communities to think of their older members as the government?s problem.)

Dean Zerbe, once the terror of the tax-exempt sector as a Senate Finance Committee staffer, now sounds different as a columnist for Forbes. On New Year?s day, he blogged:

One of the best things of the Bush tax cuts was the elimination of ?PEPS? and ?Pease? ? shorthand ?for phase outs of personal exemptions and certain itemized deductions.? These are in effect hidden marginal rate increases.? Unfortunately, the tax deal brings these bad policies back ? albeit at a higher dollar level ? hitting folks making $250k single and $300k married.? It all sounds so very boring.? Don?t be bored ? this little understood and rarely discussed provision packs a womping tax hit of $152 billion dollars over current 2012 tax policy.

Expect more womping hits as Washington?s insatiable appetites demand ever more from all of our wallets.

50 million Android and iOS devices activated in last week of December alone
