Police: Colo. shooting suspect bought guns legally

AURORA, Colo. (AP) ? James Holmes is accused of carrying out one of the worst mass shootings in recent U.S. history, but police say there was nothing illegal about the guns and ammunition he allegedly used during a Colorado movie theater attack.

"All the weapons that he possessed, he possessed legally," Aurora Police Chief Dan Oates said. "And all the clips that he possessed, he possessed legally. And all the ammunition that he possessed, he possessed legally."

The four weapons recovered following the shootings that killed 12 and left nearly 60 people injured at a suburban Denver theater were purchased by the suspect from retail gun stores in Colorado in the last two months, authorities said Friday.

A federal law enforcement officer said Holmes bought one of the four guns ? the first of two Glock pistols ? on May 22 at Gander Mountain in Aurora, Colo. The official spoke on condition of anonymity because the probe into the shootings is ongoing.

Larry Whiteley, a Bass Pro Shops spokesman, said records show that its Denver store followed federal rules in selling a shotgun and a Glock pistol to Holmes.

"Background checks, as required by federal law, were properly conducted, and (Holmes) was approved," Whiteley said in a statement.

Gander Mountain, which sold an AR-15 assault rifle believed to be used in the shootings at a movie theater in Aurora, said the company was in compliance with state and federal laws and that it was "fully cooperating with this ongoing investigation."

A second federal law enforcement official said Holmes had a high-capacity ammunition magazine in the assault rifle. Oates said a 100-round drum magazine was recovered at the scene.

The type of ammunition magazine Holmes is accused of using was banned for new production under the old federal assault weapon ban, said Daniel Vice, senior attorney for the Brady Center to Prevent Gun Violence.

When the ban expired in 2004, gun manufacturers flooded the market with the type of high-capacity magazines Holmes used Friday, Vice said.

Oates did not specify the type of rifle but said that experts told him "with that drum magazine, he could have gotten off 50 to 60 rounds, even if it was semiautomatic, within one minute. And as far as we know, it was a pretty rapid pace of fire in that theater."

Oates said Holmes purchased ammunition over the Internet, including thousands of rounds and multiple magazines for the assault rifle.

Authorities have said that Holmes had on an all-black ensemble of protective gear at the time of the shooting. An online seller of tactical police gear told the St. Louis Dispatch (http://bit.ly/Pssg9H ) that it sold more than $300 of equipment, such as an assault vest, magazine pouches and a knife, to Holmes on July 2.

Chad Weinman, the CEO of Missouri-based TacticalGear.com, said Friday that Holmes had purchased two-day shipping for the items. He said the expedited timing for the items showed "some relevance as to what kind of mindset he was in." A message left after business hours Friday by The Associated Press was not immediately returned.

Holmes is also believed to have hurled two gas canisters into the theater before opening fire.

Holmes' gun purchases include:

? On May 28, six days after buying the first Glock, he purchased the shotgun from Bass Pro Shops in Denver.

? On June 7, Holmes bought the AR-15 assault rifle at a Gander Mountain store in Thornton, Colo.

? On July 6, Holmes returned to the Bass Pro Shops store in Denver and bought the other Glock pistol.

Julianna Joss: Now Is the Time for Leadership

When a tragedy occurs, the stunned and devastated public looks to its leaders for guidance and comfort. The constituency relies on the opinions and positions of the most respected and well-known individuals, people such as our two candidates for the United States presidency.

Sadly, as questions arise from the shootings in Colorado, the response from our leaders is not what the public seeks or needs. While both President Obama and Mitt Romney expressed sympathy on their behalf about the shootings, neither has responded to the issue at hand: should the United States implement stricter gun control laws to avoid these massacres? This is the time for our leaders to take a stance and guide the people. Unfortunately, neither rose to the occasion, seizing the opportunity to take a stance on this critical issue and open a public discourse.

There is a delicate balance between carrying out the responsibilities of an elected official, while still playing the role of a politician who is seeking an election. Certain issues, such as gun control, are deemed "toxic" because they easily alienate certain demographics and are a fast track to easily losing votes and public support. Whenever they are brought up in debates or press conferences, the politicians' answers are evasive. However, the most controversial and sensitive topics should not be avoided out of fear of unpopularity during a critical election period; rather the discussion should be clear and definitive.

The topic of gun control is extremely polarized; some adamantly advocating for their Second Amendment rights, while other concerned citizens plea for stricter laws and regulation. As a result, when a candidate for political office publicly supports a concrete position, votes are lost. Skirting around such a sensitive issue is "political" and seems like a perfect move for a candidate. It is disconcerting to see that not even a tragedy such as the Colorado shootings can incite some dialogue regarding the issue of gun control. Is popularity during an election year more important than forging a cohesive plan of action to avoid future calamities?

Whatever the stance, no matter how divided or controversial, the American public needs leadership. As a student and frequent moviegoer, I need to know that these situations will never happen again. Is it too much to ask to be safe in my high school or watching a movie on a summer night? Voters should be not concerned with where a politician's stance ranks on the political spectrum; they too want to see proactive action towards avoiding such tragedies. Americans need assurance and they expect definitive, explicit leadership. President Obama may be running for re-election, but he first and foremost is our nation's leader. The absence of public discourse on the issue of gun control has been truly deafening.

This is not the time to curry favor with special interest groups; it is the time to place the betterment and safety of the country highest on the public agenda. While many may have divergent views on what the role of guns play in ensuring personal safety and personal freedom, this should not inhibit action. I encourage our politicians to set aside the controversy and political expediency. I urge them to take strong-willed and bold steps toward a constructive and sensible direction.

Ellen Pao Lawsuit: Sexual Harassment Case Roils Silicon Valley

SAN FRANCISCO -- The Silicon Valley venture capital firm of Kleiner, Perkins, Caulfied & Byers has been generating buzz for decades, spotting early investment opportunities and making billions with companies like Google and Amazon. This summer, the attention is no different, but the reason for it is.

The firm, with a roster of senior partners including Al Gore and Colin Powell, is embroiled in a lawsuit that's the talk of the valley, exchanging nasty accusations with a junior partner who accuses Kleiner of gender bias, sexual harassment and overall boorish behavior toward women.

The legal fight offers an inside peek at the firm's jet-setting ways, internecine fights over board of director seats at "portfolio" companies and the cost of social snubs.

The lawsuit was filed by Ellen Pao, a 42-year-old Harvard Law School graduate who joined the firm in 2005.

Pao accuses Kleiner of blocking her and other women from advancement and lucrative positions she claims are reserved for men. The firm has proclaimed its innocence and alleges Pao "twisted facts and events in an attempt to create legal claims where none exists."

Pao still works at the firm, which calls itself one of the most "progressive" companies in Silicon Valley in its hiring practices. Kleiner says that one-quarter of its senior partners are women.

Since Pao filed the lawsuit in May in San Francisco Superior Court, the tech world has been abuzz. Tech web sites have closely covered the case, even live blogging routine hearings.

In larger context, Pao's suit highlights an oft-heard claim that, despite progress, it's difficult for women to break through in Silicon Valley's male-dominated culture. When Google executive Marissa Mayer was named Monday as the new CEO of Yahoo, the story was widely depicted as a testing of the valley's renowned glass ceiling.

"This is a garden variety sex harassment case," said Stanford University law professor Deborah Rhode, a sexual harassment legal expert. "It got the buzz because this is such a male dominated culture and it's such a large firm" with a good reputation.

Kleiner opened its doors in Menlo Park in 1972, when few independent investment firms existed. Its rise mirrored that of Silicon Valley's. The firm's early investments in some of the computer industry's biggest names propelled it to prominence. There were few if any women at the top of the firm's organization chart for most of its history, a reflection of the all-male culture that was prevalent when Silicon Valley emerged.

Kleiner has hired high-priced employment attorney Lynn Hermle to do battle with Pao's equally high-profile attorney, Alan Exelrod, who in 1998 won a $7 million sexual harassment judgment from what then was the world's largest law firm, Baker & McKenzie.

Hermle's first line of defense is an attempt to move the lawsuit from the public glare of open court to the closed doors of arbitration, where private judges render confidential decisions. Judge Harold Kahn will hear Kleiner's arguments for arbitration on Friday.

Regardless of what happens next, damage already is done.

"The last several days have been a difficult time for me and my partners at Kleiner Perkins Caufield & Byers, a firm I'm proud to have been a part of for 32 years," senior partner John Doerr said in a recent Web message to the firm's employees. "It is not easy to stand by as false allegations are asserted against the firm, especially because legal constraints prevent us from responding fully at this time."

The firm's senior partners and lawyers are refusing to discuss the case with the media, referring reporters to its publicly accessible court filings. Similarly, Pao and her attorney claim they aren't seeking media attention and are also declining to comment.

But the court records are full of accusations, counter accusations and long-simmering resentments of Pao and her bosses at Kleiner, who labeled her a poor performer passed over for promotion only for lack of merit.

Pao earned an undergraduate engineering degree from Princeton University and a law degree from Harvard. While working for a prestigious law firm, she earned a master's of business administration from Harvard and ultimately went to work in June 2005 as Doerr's chief of staff at Kleiner. She said she was called a "junior partner" and was told she would move into a full-time investing role in three years if she did a good job.

She claims her troubles at the firm started almost upon her arrival.

Pao said she filed her lawsuit after enduring five years of harassment from Ajit Nazre, a junior partner when she was hired who was later promoted to senior partner. Nazre left the firm in January and didn't respond to email and phone messages.

Pao claims that senior partners such as Doerr ignored her complaints about Nazre. She concedes she and Nazre had "two or three" consensual sexual encounters but alleges he began harassing her after she broke off their relationship.

According to her lawsuit, Nazre began excluding her from important meetings, email chains and withholding necessary information for her to succeed at Kleiner. Instead of addressing her alleged problems, Pao claims partners either ignored her complaints, joined in her ostracism ? or worse.

She said senior partner Ray Lane pressured her to drop her complaints and suggested that she should marry Nazre. She also claims another senior partner, Randy Komisar, sent her a sexually explicit book of poems and pictures on Valentine's Day 2007 with a handwritten inscription.

The firm said Pao never complained about Nazre or any other harassment until she hired her attorney in late 2011. The firm claims that she even thanked Lane for supporting her during her breakup with Nazre, a "married peer."

Pao also charges she was excluded from business-related outings that included a private jet ski trip to Vail, similar jet trips to New York and important dinner parties with influential executives hosted at a senior partner's San Francisco residence. Pao alleges that the dinner snubs were particularly embarrassing because she lived in the same building and ran into attendees arriving for dinner. Pao said she was told the dinner affairs were attended exclusively by men because women "kill the buzz."

Kleiner's attorneys accuse Pao of misconstruing Komisar's gift, which the company says was actually purchased by Komisar's wife. The book at issue is Leonard Cohen's "The Book of Longing," which the songwriter wrote during his five-year stay at a Zen monastery. Komistar is a Buddhist.

Adding further intrigue, Pao's husband, Alphonse "Buddy" Fletcher Jr., is involved in a well-publicized racial discrimination lawsuit in New York City with the Dakota Apartments ? the place where John Lennon was killed ? over his attempts to buy a fifth apartment. Fletcher is a well-known philanthropist who lived with his same-sex partner at the Dakota for 10 years until marrying Pao in 2007. They have a 3-year-old daughter.

Regardless of whether the case plays out publicly in court or behind closed doors in arbitration, longtime observers of the Silicon Valley scene are taken aback that the venerable firm is accused of such unseemly conduct.

Jamis MacNiven, owner of the iconic Silicon Valley watering hole Buck's of Woodside that Kleiner partners have frequented for decades, said he was stunned to learn of the lawsuit because of the firm's "impeccable reputation."

"These are the most normal people in the world," MacNiven said.

building-on-what-we-gotRight away, industry representatives met with city officials and councillors to try and figure out what was causing the breakage and how to prevent it from happening again. Then, when the Ministry of Municipal Affairs and Housing created the Expert Advisory Panel on the Glass Panels in Balcony Guards, both BILD and the OHBA made sure they were at the table representing the industry and the numerous homeowners across the GTA.

Last week, the province released an interim solution that came in the form of an amendment to the Ontario Building Code. What it means is that starting July 1, construction companies will be using heat-strengthened laminated glass when the glass is close to the edge of a balcony. This glass is the same type of glass used in car windshields and is less prone to shatter. Companies are also required to use heat-strengthened laminated glass or heat-soaked tempered glass where glass balcony guards are inset from the edge of the balcony.

The amendment was a recommendation of the Expert Panel, which produced a report you can read on the Province?s website. The Panel was made up of 25 representatives including engineers, building code consultants, developers and contractors, designers, municipal staff and insurers. The Canadian Standards Association also participated and is now going to develop a national standard for glass panels in balcony guards.

From the beginning, the Expert Panel?s mandate was to make recommendations on how to improve the building process. During the discussions, it was clear that it was most important to everyone that we find solutions rather than find fault.
Our industry builds 40,000 homes every year across the GTA, and for every aspect of the building process, there are specific standards to meet. Those standards are set out in the Ontario Building Code and as we say at the Association: Code is King. The Code is reviewed every five years and as an association we are involved in and support the continuous improvement of the Code as products and technology evolve over the years. This latest amendment to the Code is the first step toward developing a new standard and the use of heat-strengthened laminated glass will increase the safety of glass panels in balcony guards.
